Plain-language summary; the final text is pending legal review.

These Terms are the rules for using YouCanDo Rent (rentycd.com), the peer-to-peer car rental marketplace where vehicle owners (“hosts”) list their cars and drivers (“guests”) book them. Please read them together with our Privacy Policy.

1. Who we are and agreeing to these Terms

YouCanDo Rent is operated by You Can Do Inc. (“we”, “us”), a corporation incorporated in [to be confirmed], with its address at [to be confirmed].

By creating an account, listing a vehicle or booking a trip, you agree to these Terms. If you do not agree, please do not use YouCanDo Rent.

2. What YouCanDo Rent is

YouCanDo Rent is a marketplace. Hosts list their own vehicles, set the daily price, mileage limit, delivery options and availability, and decide whether to accept each booking request. Guests book and drive those vehicles.

We provide the platform: accounts, identity verification, payments, the booking chat and the pickup and return check-in. We do not own, rent out, inspect or maintain the vehicles listed, and we are not a party to the arrangement between a host and a guest, apart from our role in handling payments.

3. Eligibility and your account

  • You must be at least 18 years old and able to enter into a binding contract to have an account.
  • Guests must hold a valid driver’s license for the vehicle they book, and meet any higher minimum driver age required by law or by the vehicle’s insurance.
  • You sign in with your email address. Keep your login details secure: you are responsible for what happens on your account.
  • Give us accurate information and keep it up to date. One person, one account.

4. Identity verification

Before you can list or book a vehicle, you must verify your identity with your driver’s license through Stripe Identity. Stripe checks that the document is genuine and belongs to you, and tells us the result.

We may ask you to verify again, and we may decline or cancel a listing or booking if verification fails or your details do not match.

5. If you are a host

  • You must own the vehicle, or be authorized by its owner to rent it out, and it must be registered, roadworthy and insured as your state requires.
  • Do not list a vehicle with an open safety recall until it has been repaired.
  • Keep your listing accurate: make, model, year, photos, location, price, mileage limit, overage rate, fuel type, add-ons and any delivery offer.
  • Keep your calendar up to date and honor the bookings you accept. Repeated cancellations may lead to your listing being hidden or your account being suspended.
  • Payouts are made to your Stripe Connect account. You must complete Stripe’s onboarding to be paid. You are responsible for the taxes on your earnings, and Stripe may send you a Form 1099-K where the law requires.

6. If you are a guest

  • Only you, the verified guest who booked, may drive the vehicle.
  • Obey traffic laws. Never drive under the influence of alcohol or drugs.
  • Do not use the vehicle for ride-hailing, delivery or other commercial work, racing, towing, off-road driving or anything illegal.
  • Return the vehicle on time, to the agreed place, with the same fuel or charge level and in the same condition, apart from normal wear and tear.
  • You are responsible for tolls, parking, traffic tickets and fines incurred during your trip.
  • Report any accident, damage, breakdown or theft to the host in the booking chat right away, and to the police where the law requires.

7. Bookings, check-in and return

A booking request becomes a booking when the host accepts it and the guest pays.

At pickup the host, and at return the guest, file a check-in in the app with photos of the odometer, the fuel gauge and the condition of the vehicle. These check-ins are the shared record of the trip. We use an automated tool to read the odometer and fuel gauge from the photos; a person reviews any reading the tool is not confident about.

When the trip is over, either party marks it complete in the app.

8. Prices, fees and payment

  • The guest pays the trip price (the host’s daily rate times the number of days), plus any delivery fee and add-ons, plus our 4% guest service fee on the trip price. The full amount is shown before you pay.
  • The host receives the trip price, delivery fee and add-ons, minus our 4% host service fee on the trip price.
  • Prices are in US dollars. Where the law requires us to collect taxes or fees on a trip, they are shown before you pay.
  • Stripe processes all card payments. We never see or store your full card number.
  • You can also pay a booking with YCD Wallet (see below).
  • We hold the guest’s payment until the trip is completed, then release the host’s payout through Stripe Connect.

9. Extra charges after a trip

If a trip goes over the listing’s mileage limit, or the vehicle comes back with less fuel or needing cleaning, the guest may be charged the amounts set out in the listing (such as the per-mile overage rate), based on the check-in records. We charge the card used for the booking. When the booking was paid with YCD Wallet, we charge the card the guest saved for these charges when paying.

Charges based on a clear photo reading may be billed automatically; all others are reviewed by our team first. If you disagree with a charge, write to support@rentycd.com with your booking details and we will review it.

10. Cancellations and refunds

Guests and hosts can cancel a booking in the app before the trip is completed. When a paid booking is canceled, the guest receives a full refund, including our service fee, to the original payment method. Refunds to a card usually arrive within 5 to 10 business days, depending on your bank; refunds of YCD Wallet payments go back to YCD Wallet right away.

11. YCD Wallet

YCD Wallet is one balance you can use in every YCD app. It is operated by You Can Do Inc. You add money to it by card, and in YouCanDo Rent you can use it to pay for a booking.

  • Money in YCD Wallet can only be spent in YCD apps. YCD Wallet is not a bank account, earns no interest, and its money cannot be sent to other people or withdrawn.
  • Your balance does not expire.
  • A payment from YCD Wallet covers the whole booking. Because extra charges after a trip are charged to a card, you save a card when you pay with YCD Wallet; it is not charged at that time.
  • Refunds of payments made with YCD Wallet, such as a canceled booking, go back to your YCD Wallet.
  • Where the law requires it, YCD support pays out a remaining balance on request. Write to support@rentycd.com.

12. Insurance and damage

The insurance that applies during a trip, and who provides it: [to be confirmed by counsel].

Until that is set out here, hosts must keep their vehicle insured as their state requires, and hosts and guests should check whether their own auto insurance covers peer-to-peer car sharing before a trip. Many personal policies do not.

To the extent the law allows, guests are responsible for loss of or damage to the vehicle during their trip, other than normal wear and tear.

13. Messages, reviews and fair treatment

  • Use the booking chat for everything about a trip, and keep payments on YouCanDo Rent. Do not ask for or accept payment outside the platform.
  • After a trip, guests and hosts can review each other. Reviews must be honest and about the trip.
  • Do not discriminate against anyone on the basis of race, color, religion, national origin, sex, sexual orientation, gender identity, disability, age or any other characteristic protected by law.

14. Acceptable use

Do not break the law, misrepresent yourself or a vehicle, harass or threaten anyone, create fake accounts or reviews, or scrape, overload or try to break into YouCanDo Rent. We may remove content, cancel bookings, or suspend or close accounts that break these Terms.

15. Your content

You keep ownership of the photos, listings, reviews and messages you post. You give us a non-exclusive, worldwide, royalty-free license to host, display, adapt and use them to operate and promote YouCanDo Rent. Only post content you have the right to share.

16. Suspension and closing your account

You can ask us to close your account at any time by writing to support@rentycd.com. We may suspend or close an account, remove a listing or cancel a booking if you break these Terms, if the law requires it, or to protect someone’s safety. Where appropriate, we will tell you why and give you a chance to respond.

17. Disclaimers and limitation of liability

YouCanDo Rent is provided “as is”. We do not guarantee that it will always be available or free of errors, and we do not guarantee the condition, safety or legality of any vehicle, or the conduct of any host or guest.

To the fullest extent the law allows, You Can Do Inc. is not liable for indirect, incidental, special, consequential or punitive damages arising from your use of YouCanDo Rent. Nothing in these Terms limits liability that cannot be limited by law.

18. Problems between hosts and guests

If something goes wrong on a trip, try to sort it out in the booking chat first. If you cannot, contact support@rentycd.com: we can review the check-in records and messages and help, but we are not required to resolve disputes between users.

19. Disputes with us

How disputes between you and You Can Do Inc. are resolved, and which law governs these Terms: [to be confirmed by counsel].

In the meantime, if you have a concern, write to support@rentycd.com and we will try to help.

20. Changes to these Terms

We may update these Terms. If a change is material, we will tell you by email or in the app before it takes effect. The date at the top of this page shows the current version.
